PEXA is regulated by the Registrar in each State where it is active.
The Australian Registrars’ National Electronic Conveyancing Council (ARNECC) was established to facilitate and coordinate a national approach for the development and ongoing maintenance of the regulatory framework for e-conveyancing in Australia.
ARNECC is comprised of the Registrar of each state and the NT and its principal function is advisory. Registrars from each state and territory are responsible for regulation in their own jurisdiction.
Under the Electronic Conveyancing National Law (ECNL), ARNECC has determined Model Operating Requirements (MORs) and Model Participation Rules (MPRs), with which Electronic Lodgement Network Operators (ELNOs) and their subscribers must comply. Currently, PEXA is Australia’s only electronic conveyancing platform capable of multi-party transactions.
To ensure the integrity of the network, ARNECC has developed a regulatory framework, under which PEXA operates. Industry safeguards include the Participation Agreement, Verification of Identity and Digital Certificates.
To further ensure the integrity of the network, PEXA has a number of subscriber policies and agreements in place. These include the Participation Agreement, Service Charter and Security Policy amongst others.
The Electronic Conveyancing Group comprises the Australian Bankers’ Association, Australian Institute of Conveyancers and Law Council of Australia. As representatives for their respective industries, PEXA and the ECG work closely together in creating ongoing improvements and efficiencies through variations to the Representative Subscriber Participation Agreement.
ABA and COBA act as Representative Bodies for the Financial Institution Subscribers within the network. PEXA consults with the ABA and COBA for all proposed variations to the Financial Institution Participation Agreement and Service Charter.
PEXA also works closely with the ABA and COBA on behalf of their respective members in relation to industry reforms, such as the National Mortgage Form.
The AIC are an incredible supporter of the digital efficiencies borne through PEXA and assist their members through a robust Electronic Conveyancing Accreditation Program. PEXA works closely with the AIC at both a state and national level through conferences, publications and industry sessions.
The law societies in each state support industry transformation by exchanging news, information and articles for publication. The state law societies also co-present industry events about online property settlement with PEXA.
