The PEXA group of companies comprises Property Exchange Australia Limited (ACN 140 677 792) (“PEXA”), its ultimate holding company, and any Australian subsidiaries of that ultimate holding company (referred to in this document as “PEXA Group”, “we” or “us”).
PEXA and PEXA Group entities commit to the following principles relating to the use and disclosure of data obtained by PEXA in its role as an Electronic Lodgement Network Operator (“information”) within the PEXA Group of companies.
How we handle information – core principles
- PEXA will share information with other entities within the PEXA Group in accordance with its statutory and contractual obligations – including the Model Operating Requirements, Participation Agreements, Operating Agreements and applicable privacy laws.
- Where information is approved to be used or disclosed within the PEXA Group subject to conditions, PEXA will ensure other PEXA Group companies only use and disclose the information in accordance with those conditions.
- Where de-identified information is to be shared within the PEXA Group, PEXA will ensure that once de-identified, information won’t be able to be re-identified, or reverse engineered to identify an individual.
- PEXA will be open and transparent with individuals about how personal information will be collected, used and disclosed, including by complying with the PEXA Group Privacy Policy.
Use of information within the PEXA Group
PEXA Group entities may use information to create property related products and services, which may be made available to third parties on a commercial or non-commercial basis. PEXA Group entities may use information in conjunction with data sourced from external information suppliers to create property related products and services.
Where information is used for this purpose, PEXA will ensure that PEXA Group entities only produce property related products and services that:
- benefit industry, government, customers and the broader community;
- present data accurately (or where the product or service includes predictions or estimates, use reasonable assumptions), are professional and not misleading or sensational;
- will not breach any laws, including any privacy laws;
- will not disclose any personal information unless the disclosure is made to or at the request of the person who is the subject of the Personal Information or whose consent to that disclosure is obtained; and
- are not for the purposes of direct marketing, list brokering, promotions, or mail merge functionality.
